⚠ Important Notice: Data Sharing with Event Sponsors

Where you register for a CliniLink event or webinar, we will share the following personal data with the event sponsor(s) and/or presenter(s) for the purposes of regulatory compliance under the ABPI Code of Practice for the Pharmaceutical Industry (2024 edition):

  • Your full name;
  • Your professional job title;
  • Your organisation name and postcode.

This sharing is required to enable sponsors to comply with their legal and regulatory obligations, including the annual disclosure of transfers of value to healthcare professionals under Clause 28 of the ABPI Code and the recording of sponsored event attendance.

Your email address will only be shared with event sponsors where you have given your separate, explicit consent at the point of registration. You may attend events without giving this consent.

Your professional registration number (GMC, NMC, GPhC, HCPC, or other) is collected by CliniLink for identity verification purposes only and is not shared with sponsors.

Personal data is stored and processed in the United Kingdom wherever possible. Where any personal data is transferred outside the UK, an appropriate safeguard is in place. For full details of how we use your data, please read our Privacy Policy at https://clinilink.co.uk/privacy-policy.

 

1. Introduction and Agreement to Terms

1.1 Welcome to CliniLink. CliniLink Ltd ("CliniLink", "we", "us", "our") is a company registered in England and Wales, whose registered office is at Stockport Pyramid, Yew Street, Stockport Trading Estate, Stockport, SK4 2JZ. ICO Registration Number: ZB896601.

1.2 By accessing the CliniLink platform at https://clinilink.co.uk, creating an account, registering for or attending any event or webinar, or otherwise using any CliniLink service, you agree to be bound by these Terms and Conditions ("Terms") in their entirety. If you do not agree, you must not access or use our services.

1.3 These Terms constitute a legally binding agreement between you and CliniLink Ltd, governed by the laws of England and Wales. They should be read alongside our Privacy Policy, which is incorporated by reference.

1.4 CliniLink services are intended for registered healthcare professionals (HCPs) and other eligible professionals in the United Kingdom. By using our services, you confirm that you hold a current and valid registration with a UK healthcare regulatory body (such as the GMC, NMC, GPhC, or HCPC), or that you are accessing the platform in another capacity expressly permitted by CliniLink.

1.5 These Terms comply with the Consumer Rights Act 2015, the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 (PECR), and the ABPI Code of Practice for the Pharmaceutical Industry (2024 edition).

2. Registration and Account Management

2.1 Registration may be required to access certain services, events, and areas of the CliniLink platform. By registering, you represent and warrant that all information you provide is accurate, complete, current, and not misleading, and that you are a registered healthcare professional with a current, valid registration with a recognised UK healthcare regulatory body.

2.2 You must promptly notify CliniLink at admin@clinilink.co.uk of any change to your registration details, including any change to your regulatory registration status.

2.3 CliniLink reserves the right to approve or reject any registration at its sole and absolute discretion and without giving reasons. CliniLink may suspend or terminate an account immediately where it has reasonable grounds to believe that registration information is inaccurate or misleading, or that a user's professional registration has lapsed, been suspended, or been revoked.

2.4 Your account credentials (username and password) are personal and strictly confidential. You must not share, transfer, or disclose them to any third party. You are responsible for all activity carried out under your account. Unauthorised sharing of account credentials may result in immediate suspension or permanent termination of your account.

2.5 You must notify CliniLink immediately at admin@clinilink.co.uk upon becoming aware of any unauthorised access to or use of your account.

3. Use of Services

3.1 CliniLink grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the platform and services solely for your own professional development and educational purposes.

3.2 All content, services, and materials provided by or through CliniLink are for informational and professional use only. Unauthorised copying, recording, screenshotting, live-streaming, downloading, distributing, or reproducing any content in whole or in part is strictly prohibited without the prior written consent of CliniLink.

3.3 You must conduct yourself professionally and respectfully at all times when engaging with CliniLink services, including during events, webinars, polls, and online interactions. Any inappropriate, offensive, or unprofessional behaviour may result in immediate access restrictions, account suspension, or termination without notice.

3.4 CliniLink reserves the right to modify, suspend, withdraw, or discontinue any service at any time and without notice or liability. Where a paid service is withdrawn after payment has been received, CliniLink will provide a pro-rata refund in respect of any unused portion.

3.5 Communications and Marketing: We send three distinct kinds of email and we keep them separate.

Service emails relate to your account, your bookings, your payments, your attendance and your certificates. They are necessary in order to provide the services you have asked for. They are not marketing, they contain no promotional content, and they are sent to all users regardless of marketing preferences.

CliniLink marketing emails tell you about CliniLink events, courses, programmes and educational content. Where you create an account or register for a CliniLink service, we may send you marketing about our own similar educational services. You may unsubscribe at any time using the link contained in every such email, or by contacting admin@clinilink.co.uk.

Promotional communications relating to medicines. Some of our programmes, events and webinars are commissioned and funded by pharmaceutical companies. The content of those activities, and the emails we send about them, may be developed, written, reviewed, approved or certified by, or on behalf of, the pharmaceutical company concerned, and may contain promotional content about that company's medicines. Where we send you such an email, we do so on behalf of that company as well as on our own behalf. We send these emails only where you have given us separate prior permission to receive them.

That permission:

(a) is separate from, and additional to, your general marketing preferences;

(b) is given by a positive action and never by silence, inactivity or a pre-ticked box;

(c) is informed, meaning that before you give it we tell you that the communications may contain content developed, written, reviewed or approved by or on behalf of a named pharmaceutical company, that they may be promotional in nature, and that we send them on that company's behalf;

(d) is recorded together with the wording shown to you, the version of that wording, the date and the method by which permission was given; and

(e) may be withdrawn at any time using the unsubscribe link contained in every such email, or by contacting admin@clinilink.co.uk.

If you have not given this permission, we will not send you promotional communications relating to medicines, and we will not email you to ask you to give it.

Withdrawing your permission does not affect your service emails, your general marketing preferences, or your access to any event or programme you have registered for.

We keep our mailing lists up to date. Requests to be removed from any mailing list are actioned promptly. Your name will not be restored to a promotional mailing list except at your request or with your permission.

Nothing in this clause overrides your rights under PECR or the UK GDPR.

3.6 Recording of Events — Consent to Recording: CliniLink may record events and webinars (whether in person or virtual) for quality assurance, educational, archival, and CPD purposes. By registering for and attending any CliniLink event or webinar, you acknowledge and consent to the event being recorded by CliniLink, including any oral or visual contributions you make during the session.

If you do not wish your contributions to be included in a recording, please notify CliniLink at admin@clinilink.co.uk prior to the event. We will use reasonable endeavours to accommodate your request, for example by asking you to use the written chat or Q&A functions rather than contributing verbally. Please note that your participation in the event itself will not be affected by making this request.

If you wish to be removed from an existing recording after the event, please contact admin@clinilink.co.uk with details of the event and the nature of your contribution. We will assess removal requests on a case-by-case basis in accordance with your rights under UK GDPR (including the right to erasure under Article 17) and will respond within one calendar month.

Unauthorised recording by delegates and sponsors: Attendees, delegates, and Sponsor representatives must not themselves make any recording of any CliniLink event or webinar without the prior written consent of CliniLink. This includes audio recording, video recording, screen recording, screenshots, transcription, or any other method of capture. Any unauthorised recording constitutes a material breach of these Terms and may constitute unlawful processing of personal data under UK GDPR.

4. ABPI Compliance and Sponsored Events

4.1 Some CliniLink events and webinars are sponsored by pharmaceutical companies, medical device companies, or other healthcare industry organisations ("Sponsors"). Where an event is sponsored, this will be clearly stated in the event details prior to registration.

4.2 Data Sharing with Sponsors — Required for ABPI Compliance: Where you register for a sponsored CliniLink event or webinar, the following personal data will be provided to the event Sponsor(s) and/or presenter(s) after the event has concluded, for the purposes of ABPI Code of Practice compliance, annual transfers of value disclosure (Clause 28, ABPI Code 2024 edition), and attendance verification:

  • Your full name;
  • Your professional job title; and
  • Your organisation name and postcode.

This data sharing is required to enable Sponsors to fulfil their legal and regulatory obligations under Clause 28 of the ABPI Code of Practice (2024 edition) in relation to the annual disclosure of transfers of value to healthcare professionals. The legal basis for this processing is legitimate interests (Article 6(1)(f) UK GDPR). This sharing will take place regardless of whether consent has been given, as it is a condition of attending a sponsored event.

4.3 Your Right to Opt Out of Named Disclosure — How It Works: If you wish to discuss your data sharing preferences before registering, please contact us at admin@clinilink.co.uk prior to completing your registration.

Under the ABPI Code, you have the right to opt out of being named individually in a sponsor's annual disclosure. If you exercise this right, your attendance will instead be recorded and disclosed by the Sponsor as an aggregate transfer of value (i.e. without your name attached). You may still attend the event on this basis. To request aggregate-only disclosure, please contact admin@clinilink.co.uk before registering and we will liaise with the relevant Sponsor on your behalf.

Important: For events sponsored by pharmaceutical companies, some form of transfer of value disclosure is required under the ABPI Code of Practice regardless of individual preference. The sponsor must always record that the event took place and that a transfer of value occurred, even if your name is not individually disclosed. Delegates who are unwilling to permit any disclosure whatsoever (including aggregate) should be aware that attendance at a sponsored event may not be compatible with the sponsor's regulatory obligations under the ABPI Code. In such cases, CliniLink reserves the right to decline registration for that sponsored event. We will always endeavour to make available a suitable non-sponsored event or alternative where possible.

4.4 Email Address Sharing — Consent Required: Your email address will only be shared with event Sponsors for marketing or follow-up communications where you have given your separate, explicit, and freely given consent at the point of registration. This consent is entirely optional — you may attend any event without providing it. You may withdraw this consent at any time by contacting admin@clinilink.co.uk or using the unsubscribe link in any communication received from a Sponsor.

4.5 Your professional registration number (GMC, NMC, GPhC, HCPC, or other regulatory body registration number) is collected by CliniLink solely for the purpose of verifying that you are a registered healthcare professional. It is not shared with Sponsors or any other third party.

4.6 Once your data has been shared with a Sponsor, that Sponsor will act as an independent data controller in respect of their subsequent processing. CliniLink is not responsible for a Sponsor's processing of that data. To exercise your data subject rights in relation to data held by a Sponsor, you will need to contact that Sponsor directly.

4.7 Attendance at a sponsored event may constitute a declarable transfer of value under the ABPI Code. You are solely responsible for making any declarations required by your employer, regulatory body, or professional code in relation to your attendance.

4.8 Activities Containing Promotional Content, and Adverse Event Reporting: Certain CliniLink events, webinars and programmes are commissioned and funded by a pharmaceutical company. The content of those activities may be developed, written, reviewed, approved or certified by, or on behalf of, that company, and may contain promotional content relating to that company's medicines.

Before you register for or access such an activity, we will tell you who developed the content, who commissioned and funded it, whether the funding company wrote, reviewed, approved or certified any part of it, that it is promotional, and which parts contain information about a medicine. The company will be named.

Access to an activity containing promotional content relating to prescription only medicines is restricted to UK registered healthcare professionals, and requires you to confirm that you are a UK registered healthcare professional and that you agree to access promotional content which may have been developed by or on behalf of that company. That confirmation is recorded. It is separate from, and does not require, the permission described in clause 3.5, and declining that permission will not affect your access.

Promotional content is provided for your professional education. It does not replace your own clinical judgement, the Summary of Product Characteristics, or any applicable national or local guidance. Prescribing information and details of how to report adverse events are made available throughout any such activity.

Adverse events: If you report a suspected adverse reaction, side effect or product complaint relating to a medicine, whether during an event, through a course, a survey response or comment, or by email, we are required to pass the relevant details to the pharmaceutical company concerned and, where appropriate, to the Medicines and Healthcare products Regulatory Agency. This processing is necessary to comply with a legal obligation. It does not rely on your consent and cannot be withdrawn by you.

5. Liability and Disclaimer

5.1 The content and information provided through CliniLink services is intended for general educational and professional development purposes only. It does not constitute, and must not be relied upon as, medical, clinical, legal, pharmaceutical, or other professional advice. You must always exercise your own independent professional judgement.

5.2 CliniLink takes reasonable care to ensure that content is accurate and up to date at the time of publication. However, CliniLink makes no representation or warranty, whether express or implied, as to the accuracy, completeness, or fitness for purpose of any content, and expressly excludes all implied warranties to the fullest extent permitted by law.

5.3 CliniLink shall not be liable to any user for:

  • any reliance placed on, or any clinical decision made in connection with, any content provided through the platform;
  • any errors, omissions, or inaccuracies in any content;
  • any interruption, suspension, or unavailability of the platform or any service;
  • any loss or corruption of data; or
  • any technical issues, including internet connectivity problems, software incompatibility, or third-party platform failures.

5.4 Nothing in these Terms shall exclude or limit CliniLink's liability for: (a) death or personal injury caused by CliniLink's negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law, including under the Consumer Rights Act 2015.

5.5 Subject to Clause 5.4, CliniLink's total aggregate liability to any user arising from these Terms or the use of the platform shall not exceed the total fees paid by that user to CliniLink in the twelve months preceding the event giving rise to the claim, or £100, whichever is the greater.

5.6 Content presented by external speakers or Sponsors at CliniLink events represents the views of those individuals or organisations and does not necessarily reflect the views or policies of CliniLink. CliniLink does not endorse, verify, or accept responsibility for statements made by third-party speakers or Sponsors. Where content has been certified by a pharmaceutical company as promotional material, this will be stated in accordance with clause 4.8.

6. Privacy and Data Protection

6.1 CliniLink Ltd is registered with the Information Commissioner's Office (ICO) as a data controller under registration number ZB896601. By using CliniLink services, your personal data will be collected and processed in accordance with our Privacy Policy, available at https://clinilink.co.uk/privacy-policy.

6.2 Personal data is stored and processed in the United Kingdom wherever possible. Some of our service providers operate outside the United Kingdom. Where personal data is transferred internationally, we ensure that an appropriate safeguard is in place, which may be a transfer to a country covered by UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or another lawful transfer mechanism. Details are set out in our Privacy Policy and are available on request.

6.3 Where you register for a sponsored event, your data will be shared with event Sponsors as described in Clause 4 above. By completing your registration, you acknowledge this sharing and confirm that you have read and understood Clause 4.

6.4 You have the following rights in relation to your personal data under UK GDPR: the right to access, rectify, erase, restrict processing of, and port your data; the right to object to processing; and the right to withdraw consent at any time where processing is based on consent. To exercise any of these rights, please contact admin@clinilink.co.uk.

6.5 You have the right to lodge a complaint with the Information Commissioner's Office (ICO) at https://ico.org.uk or on 0303 123 1113 if you have concerns about how CliniLink handles your personal data.

6.6 Recording of Events: CliniLink may record events and webinars for quality assurance, educational, archival, and CPD purposes. Recordings may include contributions made by delegates during a session. By registering for a CliniLink event, you consent to being recorded. If you wish to opt out of having your contributions included in a recording, or if you wish to request removal from an existing recording, please contact admin@clinilink.co.uk. All recordings are processed in accordance with our Privacy Policy and UK GDPR. Unauthorised recording by attendees or Sponsor representatives remains strictly prohibited (see Clause 3.6).

7. Payments and Refunds

7.1 Where applicable, fees must be paid in full prior to accessing paid services or events. The applicable fee will be clearly stated on the relevant booking or registration page at the time of registration.

7.2 All fees are stated in pounds sterling (GBP) and are inclusive of VAT (where applicable) unless otherwise stated.

7.3 Refunds will only be issued in the following circumstances:

  • Cancellation by CliniLink: Where CliniLink cancels a paid event or service, you will receive a full refund of any fee paid within 14 days of cancellation.
  • Exceptional Circumstances: CliniLink may, at its sole discretion, consider refund requests in exceptional circumstances. Requests must be made in writing to admin@clinilink.co.uk within 14 days of the relevant event date.

7.4 Nothing in this Clause 7 affects your statutory rights under the Consumer Rights Act 2015.

No-Show Fee

7.5 For free-of-charge events (including but not limited to face-to-face and physical events), CliniLink reserves the right to levy a no-show fee where a registered delegate fails to attend without cancelling their booking at least 48 hours before the advertised start time of the event.

7.6 Where a no-show fee applies, this will be clearly stated on the relevant event details page at the time of registration. By completing your registration, you acknowledge and agree to the no-show fee policy. The amount of any applicable no-show fee will be specified on the event details page.

7.7 CliniLink reserves the right to restrict access to future events where a no-show fee remains outstanding.

8. Professional Standards and Conduct

8.1 CliniLink services are delivered to support the continuing professional development and education of registered healthcare professionals. By using CliniLink services, you confirm that your use is consistent with your professional obligations under the standards set by your relevant regulatory body (GMC, NMC, GPhC, HCPC, or other).

8.2 Nothing in these Terms, and nothing in any content or service provided by CliniLink, supersedes, modifies, or overrides the professional obligations you owe to your regulatory body, employer, or patients. You are solely responsible for ensuring that your use of CliniLink services is compatible with your professional obligations, and for the manner in which you apply any knowledge or information obtained through the platform in your professional practice.

8.3 You must conduct yourself professionally and respectfully at all times when using CliniLink services, including during events, webinars, online polls, and any interactive features. You must not engage in any form of harassment, bullying, intimidation, or discriminatory behaviour towards other delegates, CliniLink staff, or speakers.

8.4 CliniLink reserves the right to suspend or terminate your access immediately and without notice if it reasonably considers that you have: (a) breached these Terms; (b) breached any applicable law or professional code; (c) provided false or misleading registration information; or (d) engaged in conduct that may bring CliniLink or the healthcare profession into disrepute.

8.5 No solicitation or promotion: You must not use CliniLink events, webinars, or interactive features to advertise, promote, market, or sell your own (or any third party's) business, products, or services, or to solicit other delegates, staff, or speakers, without CliniLink's prior written consent. This includes distributing promotional materials, sharing commercial links or contact details in chat or polls, and any other commercial solicitation. CliniLink may remove or refuse entry to anyone who breaches this clause.

9. Intellectual Property

9.1 All intellectual property rights in and to the CliniLink platform, content, and materials are owned by or licensed to CliniLink Ltd. Nothing in these Terms grants you any right, title, or interest in CliniLink's intellectual property other than the limited licence set out in Clause 3.1.

9.2 You must not use CliniLink's name, logo, trade marks, or branding without the prior written consent of CliniLink.

9.3 Where content has been developed for, funded by, or certified by a third party, including a pharmaceutical company, additional restrictions may apply and will be stated in relation to the relevant activity.

10. Amendments to These Terms

10.1 CliniLink reserves the right to amend these Terms at any time. Where amendments are material, CliniLink will provide reasonable notice to registered users by email or by a prominent notice on the platform, no less than 14 days prior to the amendments taking effect, except where a shorter period is required by law.

10.2 Your continued use of the platform or services after the expiry of any notice period shall constitute your acceptance of the amended Terms.

10.3 If you do not agree to any amended Terms, you must cease using the platform and services and may close your account by contacting admin@clinilink.co.uk.

10.4 Previous versions of these Terms are available upon written request to admin@clinilink.co.uk.

11. General Provisions

11.1 Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.2 Entire Agreement: These Terms, together with the Privacy Policy and any additional terms notified at the point of registration for a specific service or event, constitute the entire agreement between you and CliniLink in relation to your use of the platform.

11.3 Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

11.4 Waiver: No failure or delay by CliniLink in exercising any right shall constitute a waiver of that right.

11.5 Third Party Rights: These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

11.6 Assignment: You may not assign or transfer your rights under these Terms. CliniLink may assign or transfer its rights and obligations to a successor in connection with a sale, merger, or transfer of its business or assets.

11.7 Events Outside Our Control: CliniLink shall not be liable for any failure or delay in performing its obligations where that failure or delay results from events outside its reasonable control. Where such an event affects a paid event or service, Clause 7.3 applies.

12.2 We will acknowledge all written enquiries within five (5) working days and will provide a substantive response within twenty-eight (28) days of receipt.
